But here’s the problem… If the injured worker doesn’t recognize that there is a potential third-party claim, waiting a whole year to have the insurance carrier or self-insured employer bring a claim under F.S.A §440.39 (4)(a) may significantly jeopardize the claim. One year after the injury, witnesses will be lost, evidence will be destroyed, conditions will change and the opportunity for recovery against a third-party will be damaged significantly.
